LOCQL, Inc. ("PixoMobile") operates several websites and mobile applications including PixoMobile.com, Pixotale.com, PhotosPro, Levitagram, PoshLight, Fracecraft, Pixocast, Pixotale, AppStory, Discoverful("PixoMobile Apps") and their websites. By using the PixoMobile's products or services you are agreeing to be bound by the following terms and conditions.

PixoMobile Mobile Application Terms

When you use PixoMobile Apps on iOS devices, you are subject to the standard End User License Agreement (EULA) from Apple.

General Terms

You must be 16 years or older to use PixoMobile Apps.

Allowable Content and Use

You may NOT:

Violation of any of these agreements will result in the termination of your account. While we prohibits such conduct and content on its site, you understand and agree that we cannot be responsible for the Content posted on its web site and you nonetheless may be exposed to such materials and that you use the service at your own risk.

User Generated Content

Materials, including but not limited to photo, text, audio, videos, and content of any nature provided by PixoMobile ("Content") or by other users of PixoMobile ("User Generated Content") to PixoMobile is owned by the party contributing such content. As a user of PixoMobile, you are solely responsible for your own submissions. By transmitting your submissions to the website or otherwise through or using PixoMobile you represent that you have all rights and authorizations necessary to post, submit, display, produce, or otherwise transmit, such content. You agree that you will not submit material that is or contains the intellectual property of a third party that you do not have permission to use.

You shall retain all of your ownership rights in your submissions; however, by submitting material to PixoMobile you grant PixoMobile fully transferable rights to use, reproduce, distribute, modify, transmit, prepare derivative works of, display and produce the material in connection with PixoMobile and PixoMobile's business, but solely in accordance with these Terms of Use and our Privacy Policy. To the extent you do not have ownership rights to any of your submissions, you shall indemnify PixoMobile for any claim regarding PixoMobile's use of your submissions.

When using PixoMobile, you may be exposed to User Generated Content from a variety of sources, and PixoMobile is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such User Generated Content, which may be inaccurate, infringing, offensive, indecent, or objectionable. You understand that all information publicly posted or privately transmitted through PixoMobile is the sole responsibility of the person from which such content originated and that we are not and will not be liable for any errors or omissions in any content. You understand that we cannot guarantee the identity of any other users with whom you may interact in the course of using PixoMobile. Additionally, we cannot and do not guarantee the authenticity or accuracy of any data that users may provide about themselves or relationships they may describe.

We do not guarantee any confidentiality with respect to any User Generated Content and will not treat any User Generated Content as confidential.

Rights Reserved

PixoMobile reserves the right to modify or terminate the PixoMobile service for any reason, without notice at any time. PixoMobile reserve the right to alter these Terms of Use at any time, the changes will be determined at our sole discretion.

PixoMobile reserves the right to filter any content posted and remove objectionable posts without notice. PixoMobile may also cancel accounts for users who violate the Terms of Service.

PixoMobile respects your copyright. You retain full copyright of any original content that you send us. By posting to PixoMobile, you're granting us a license to distribute your content on this site.

PixoMobile reserves the right to ban sites and users that do not comply with our terms of service. Users may not be notified when this occurs. Banned users may contact PixoMobile Customer Support for more information. Please comply with the rules above.

DMCA Copyright Policy

PixoMobile has adopted the following policy toward copyright infringement on the Services in accordance with the Digital Millennium Copyright Act (a copy of which is located at http://www.loc.gov/copyright/legislation/dmca.pdf, the "DMCA"). The address of PixoMobile's Designated Agent for copyright takedown notices ("Designated Agent") is listed below.

Reporting Instances of Copyright Infringement:
If you believe that Content residing or accessible on or through the Services infringes a copyright, please send a notice of copyright infringement containing the following information to the Designated Agent at the address below:
  1. Identification of the work or material being infringed.
  2. Identification of the material that is claimed to be infringing, including its location, with sufficient detail so that PixoMobile is capable of finding it and verifying its existence.
  3. Contact information for the notifying party (the "Notifying Party"), including name, address, telephone number and e-mail address.
  4. A statement that the Notifying Party has a good faith belief that the material is not authorized by the copyright owner, its agent or law.
  5. A statement made under penalty of perjury that the information provided in the notice is accurate and that the Notifying Party is authorized to make the complaint on behalf of the copyright owner.
  6. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed.

After removing material pursuant to a valid DMCA notice, PixoMobile will immediately notify the Subscriber responsible for the allegedly infringing material that it has removed or disabled access to the material. PixoMobile reserves the right, in its sole discretion, to immediately terminate the account of any Subscriber who is the subject of repeated DMCA notifications.

Submitting a DMCA Counter-Notification:
If you believe you are the wrongful subject of a DMCA notification, you may file a counter-notification with PixoMobile by providing the following information to the Designated Agent at the address below:
  1. The specific URLs of material that PixoMobile has removed or to which PixoMobile has disabled access.
  2. Your name, address, telephone number, and email address.
  3. A statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located (or the federal district courts located in New York County, New York if your address is outside of the United States), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  4. The following statement: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled." Your signature.
Upon receipt of a valid counter-notification, PixoMobile will forward it to Notifying Party who submitted the original DMCA notification. The original Notifying Party (or the copyright holder he or she represents) will then have ten (10) days to notify us that he or she has filed legal action relating to the allegedly infringing material. If PixoMobile does not receive any such notification within ten (10) days, we may restore the material to the Services.

While we have the right to monitor activity and content associated with PixoMobile, we are not obligated to do so. We do not guarantee the accuracy, integrity or quality of any content submitted by users to PixoMobile. Because community standards vary and individuals sometimes choose not to comply with our policies and practices, in the process of using PixoMobile, you may be exposed to content that you find offensive or objectionable. You can contact us to let us know of content that you find objectionable. We may investigate the complaints and violations of our policies that come to our attention and may take any action that we believe is appropriate, including, but not limited to issuing warnings, removing the content or terminating accounts and/or subscriptions. We also, however, reserve the right not to take any action. Under no circumstances will we be liable in any way for any content, including, but not limited to any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of, access to, or denial of access to any content on the Website.
