AFAR Interactive, Inc. ("AFAR Interactive, Inc. ") operates several websites and mobile applications including CrossCourse, and their websites. By using the AFAR Interactive, Inc. 's products or services you are agreeing to be bound by the following terms and conditions.

AFAR Interactive, Inc. Mobile Application Terms

When you use AFAR Interactive, Inc. Apps on iOS devices, you are subject to the standard End User License Agreement (EULA) from Apple.

General Terms

You must be 16 years or older to use AFAR Interactive, Inc. Apps.

Allowable Content and Use

You may NOT:

  • Post nude, partially nude, or sexually suggestive content.
  • Post content that promotes hatred towards groups based on race or ethnic origin, religion, disability, gender, age and/or sexual orientation/gender identity
  • Post unauthorized, private, confidential and personal information about others.
  • Post content that infringes on trademarks or copyrights.
  • Post unlawful, harmful, or obscene content.
  • Abuse, harass, threaten, impersonate or intimidate other AFAR Interactive, Inc. users.
  • Post content you do not have the right to transmit.
  • Crawl content without permission.
  • Post viruses, malicious scripts, spam or link bait.
  • Link to images on AFAR Interactive, Inc. without a link to the original post.

Violation of any of these agreements will result in the termination of your account. While we prohibits such conduct and content on its site, you understand and agree that we cannot be responsible for the Content posted on its web site and you nonetheless may be exposed to such materials and that you use the service at your own risk.

User Generated Content

Materials, including but not limited to photo, text, audio, videos, and content of any nature provided by AFAR Interactive, Inc. ("Content") or by other users of AFAR Interactive, Inc. ("User Generated Content") to AFAR Interactive, Inc. is owned by the party contributing such content. As a user of AFAR Interactive, Inc. , you are solely responsible for your own submissions. By transmitting your submissions to the website or otherwise through or using AFAR Interactive, Inc. you represent that you have all rights and authorizations necessary to post, submit, display, produce, or otherwise transmit, such content. You agree that you will not submit material that is or contains the intellectual property of a third party that you do not have permission to use.

You shall retain all of your ownership rights in your submissions; however, by submitting material to AFAR Interactive, Inc. you grant AFAR Interactive, Inc. fully transferable rights to use, reproduce, distribute, modify, transmit, prepare derivative works of, display and produce the material in connection with AFAR Interactive, Inc. and AFAR Interactive, Inc. 's business, but solely in accordance with these Terms of Use and our Privacy Policy. To the extent you do not have ownership rights to any of your submissions, you shall indemnify AFAR Interactive, Inc. for any claim regarding AFAR Interactive, Inc. 's use of your submissions.

When using AFAR Interactive, Inc. , you may be exposed to User Generated Content from a variety of sources, and AFAR Interactive, Inc. is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such User Generated Content, which may be inaccurate, infringing, offensive, indecent, or objectionable. You understand that all information publicly posted or privately transmitted through AFAR Interactive, Inc. is the sole responsibility of the person from which such content originated and that we are not and will not be liable for any errors or omissions in any content. You understand that we cannot guarantee the identity of any other users with whom you may interact in the course of using AFAR Interactive, Inc. . Additionally, we cannot and do not guarantee the authenticity or accuracy of any data that users may provide about themselves or relationships they may describe.

We do not guarantee any confidentiality with respect to any User Generated Content and will not treat any User Generated Content as confidential.

Rights Reserved

AFAR Interactive, Inc. reserves the right to modify or terminate the AFAR Interactive, Inc. service for any reason, without notice at any time. AFAR Interactive, Inc. reserve the right to alter these Terms of Use at any time, the changes will be determined at our sole discretion.

AFAR Interactive, Inc. reserves the right to filter any content posted and remove objectionable posts without notice. AFAR Interactive, Inc. may also cancel accounts for users who violate the Terms of Service.

AFAR Interactive, Inc. respects your copyright. You retain full copyright of any original content that you send us. By posting to AFAR Interactive, Inc. , you're granting us a license to distribute your content on this site.

AFAR Interactive, Inc. reserves the right to ban sites and users that do not comply with our terms of service. Users may not be notified when this occurs. Banned users may contact AFAR Interactive, Inc. Customer Support for more information. Please comply with the rules above.

DMCA Copyright Policy

AFAR Interactive, Inc. has adopted the following policy toward copyright infringement on the Services in accordance with the Digital Millennium Copyright Act (a copy of which is located at http://www.loc.gov/copyright/legislation/dmca.pdf, the "DMCA"). The address of AFAR Interactive, Inc. 's Designated Agent for copyright takedown notices ("Designated Agent") is listed below.

Reporting Instances of Copyright Infringement:
If you believe that Content residing or accessible on or through the Services infringes a copyright, please send a notice of copyright infringement containing the following information to the Designated Agent at the address below:
  1. Identification of the work or material being infringed.
  2. Identification of the material that is claimed to be infringing, including its location, with sufficient detail so that AFAR Interactive, Inc. is capable of finding it and verifying its existence.
  3. Contact information for the notifying party (the "Notifying Party"), including name, address, telephone number and e-mail address.
  4. A statement that the Notifying Party has a good faith belief that the material is not authorized by the copyright owner, its agent or law.
  5. A statement made under penalty of perjury that the information provided in the notice is accurate and that the Notifying Party is authorized to make the complaint on behalf of the copyright owner.
  6. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed.

After removing material pursuant to a valid DMCA notice, AFAR Interactive, Inc. will immediately notify the Subscriber responsible for the allegedly infringing material that it has removed or disabled access to the material. AFAR Interactive, Inc. reserves the right, in its sole discretion, to immediately terminate the account of any Subscriber who is the subject of repeated DMCA notifications.

Submitting a DMCA Counter-Notification:
If you believe you are the wrongful subject of a DMCA notification, you may file a counter-notification with AFAR Interactive, Inc. by providing the following information to the Designated Agent at the address below:
  1. The specific URLs of material that AFAR Interactive, Inc. has removed or to which AFAR Interactive, Inc. has disabled access.
  2. Your name, address, telephone number, and email address.
  3. A statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located (or the federal district courts located in New York County, New York if your address is outside of the United States), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  4. The following statement: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled." Your signature.
Upon receipt of a valid counter-notification, AFAR Interactive, Inc. will forward it to Notifying Party who submitted the original DMCA notification. The original Notifying Party (or the copyright holder he or she represents) will then have ten (10) days to notify us that he or she has filed legal action relating to the allegedly infringing material. If AFAR Interactive, Inc. does not receive any such notification within ten (10) days, we may restore the material to the Services.
